# Terms of Use

## 1. Parties and scope

These terms govern the use of the Websens CRM software provided by (“Websens”). By creating an account, you accept these terms.

## 2. Service

Websens CRM is a cloud-based software service. It offers patient lead management, multichannel messaging, appointment, quote, collection tracking and reporting functions. The service is used via a browser on a subscription basis.

## 3. Account and users

- The person creating the account declares that they are authorized to represent their organization.

- You are responsible for password security and for transactions made under your account.

- You may create sub-users and limit their permissions; the account owner is responsible for the actions of sub-users.

- Persons under the age of 18 cannot create an account.

## 4. Trial and subscription

- New accounts start with a **Free for 14 days** trial; no credit card is required.

- If no package is selected at the end of the trial, account access is limited to the subscription screen; your data is not deleted.

- Packages are defined with monthly pricing. A discount applies for annual payment; the advertised rate is shown on the subscription screen.

- Prices do not include VAT.

- Payments are collected via PayTR. Your card details are not stored by us.

- Package upgrades take effect immediately.

## 5. Cancellation and refunds

- You can cancel your subscription at any time; the service continues until the end of the paid period.

- No refunds are made for a used period.

- We recommend exporting your data before closing your account.

- Upon your request, your account is permanently deleted with all its data; this action is irreversible.

## 6. Acceptable use

You may not use Websens CRM for the following purposes:

- Sending unsolicited bulk messages (spam)

- Sending content that violates applicable legislation, WhatsApp/Meta policies, or third-party rights

- Uploading data of individuals from whom you have not obtained consent

- Reverse engineering the system, overloading it, or testing its security (without written permission)

- Reselling the service under your own name (without a reseller agreement)

In case of violation of these rules, we reserve the right to suspend or close the account.

## 7. Your responsibility: you are the data controller

The patient and customer data you enter into the system **you are the data controller.** In this context:

- Obtaining the necessary notices and explicit consents from data subjects

- Complying with KVKK's special categories of data provisions if you process health data

- Granting your users only the permissions they need

- Responding to data subjects' requests

is your obligation. Websens is a data processor that processes your data only in accordance with your instructions.

## 8. Third-party integrations

Meta (Messenger, Instagram, WhatsApp), TikTok, your email server, your SMS provider, and AI providers are independent services. Outages, policy changes, or account restrictions by these services are beyond Websens' control. When using these services, you are also subject to their own terms.

Pricing for conversations via the WhatsApp Business Platform is determined by Meta.

## 9. Service continuity

We make reasonable efforts to provide the service without interruption, but 100% availability is not guaranteed. We try to announce planned maintenance in advance. Backups are taken regularly.

## 10. Intellectual property

The software, interface, source code, and brand belong to Websens. You are granted only a right of use for the duration of your subscription. The data you enter into the system belongs to you.

## 11. Limitation of liability

Websens is not liable for loss of profit, loss of business, loss of data, or indirect damages. In any case, our total liability is limited to the subscription fee you paid in the **12 months** prior to the date the incident occurred.

This limitation does not apply in cases of intent and gross negligence.

## 12. Changes

These terms may be updated. Material changes will be notified at least **15 days in advance** by email. If you do not accept the change, you may cancel your subscription.

## 13. Governing law

These terms are governed by the laws of the Republic of Turkey. In disputes, **Antalya Courts and Enforcement Offices** shall have jurisdiction.
